The IRPT Act is based on the principle that if settlors who are in a relationship decide to put assets in an international relationship property trust, and later separate, the relationship property settled must be held intact and remain upon the trusts declared. The property must not be divided and distributed among beneficiaries and must be administered and managed in accordance with the trust instrument.
This effectively provides certainty that the property will be for the benefit of the beneficiaries according to their respective beneficial shares.
